In the summer of 2024, the drugmaker Pfizer Inc. took over Pfizer’s patent for its erectile dysfunction medication Viagra to the U. S. Food and Drug Administration (FDA).
Pfizer’s patent is for the active pharmaceutical ingredient (API) in Viagra, a generic version of Pfizer’s blockbuster drug, Cialis.
The FDA is currently considering a lawsuit to force Pfizer to release an actual copy of the FDA-approved drug, known as sildenafil citrate, the generic version of Viagra.
The FDA has denied the patent to Pfizer’s generic version.
As part of the lawsuit, Pfizer’s patent for sildenafil citrate has been challenged by generic drugmakers and its patent for Viagra has been challenged by generic drugmakers.
On Wednesday, a group of drugmakers filed a suit in the U. District Court in New York against the generics makers, citing the alleged “incorrect patentation” and the FDA’s decision in the Pfizer lawsuit.
In the lawsuit, filed in March, the FDA and the makers of Viagra allege that the generic manufacturers knew or been reckless in their marketing practices, the FDA said. They also claimed that the generic companies knew or been reckless in their marketing decisions.
The suit also alleged that the generics makers, which had not yet received FDA approval to manufacture the generic versions, failed to adequately disclose the active pharmaceutical ingredient in Viagra. A company called Mylan Inc. has filed a similar suit.
Pfizer and Mylan are seeking to force the generics companies to produce Viagra that is identical to Viagra and that contains the same active ingredient, sildenafil citrate.
In its suit, the lawsuit states Pfizer is seeking an order by the FDA to issue a final decision to the generics makers.
“Pfizer has repeatedly been clear about the importance of its patent protection and its ability to produce the new drug without approval by the FDA,” said Steven Wolff, Pfizer’s chief executive. “Our goal is to ensure that Pfizer’s patent protection remains strong.”
The generic-drugmakers have filed suits in federal court in Massachusetts and the U. District Court in New York.
In the case, the plaintiffs allege that the generic drugmakers were responsible for the drug’s approval by the FDA in December 2017 and failed to disclose the drug’s active ingredient in Viagra until January 2022. The FDA is continuing to investigate.
The plaintiffs say they were unaware of the drug’s safety until December 2017, when the FDA approved it, and that the company’s failure to disclose its active ingredient, sildenafil citrate, until May 2023.
The plaintiffs also claim that the generic-drugmakers failed to disclose the drug’s “potency” and that they were unaware of the drug’s side effects.
The drugmaker Pfizer’s lawsuit, which was filed in the United States District Court in New York, seeks to force the generics companies to produce Viagra that is identical to the drug’s Viagra.
The generic-drugmakers, including Mylan Inc., and Pfizer’s, have filed lawsuits against the generic manufacturers in the United States and are seeking to force them to pay for damages caused by the plaintiffs’ injuries.
In April, the FDA ordered Pfizer to update its warning labels to reflect the risk of sildenafil citrate’s heart attack and stroke risks. The FDA said it was reviewing the updated warning labels.
The FDA said it will require the generics makers to report any changes in their labels to the FDA.
In June, the FDA required the companies to update their labeling to reflect the drug’s risks of heart attack and stroke.
The FDA has also recently issued a warning about the potential for the risk of heart attack or stroke in rare cases, including those in women and children.
The FDA has also proposed an end-of-life care plan for those with conditions like high blood pressure or heart failure that could require continued use of the medication for up to 10 years.
The lawsuit is seeking unspecified damages and attorneys fees.
